Overview
Phocus is committed to protecting your privacy. This privacy policy tells you about our online collection and use of data through the Phocus website, https://phocus.io (the “Site”), that enables site visitors (“You”, “Customers” or “Clients”) to book a photo shoot (the “Service”). By using the Site, you consent to the data collection and usage practices described in this Policy.
1. Collection of Your Personal Information
When you access the Site, Phocus may collect personally identifiable information, such as your name and email. If you purchase Phocus's products and services, we collect billing and credit card information and store photographic images. This information is used to complete the purchase transaction and render the Service. Phocus may also collect anonymous demographic information, which is not unique to you, such as your location, business, age and gender. We may gather additional personal or non-personal information in the future.
2. We will not publish or sub-license your photographic images without your permission.
Phocus may not resell or distribute images generated during a photo shoot that you have requested and paid for (“Client Images”), without your permission. Under this Privacy Policy, You provide Phocus with a limited license to use Client Images as examples within galleries on the Phocus Site and on the site of the photographer who took the photos, unless you specifically indicate that you withhold such permission from Phocus. At the time you place an order, you will have the opportunity to withhold permission for such use of Client Images. Information about your computer hardware and software may be automatically collected by Phocus as part of the process of using our on-line Service. This information can include: your IP address; browser type; domain names; access times; and referring website addresses. This information is used for the operation of the Service, to maintain quality of the Service, and to provide general statistics regarding use of the Site. Phocus encourages you to review the privacy statements of websites you choose to link to from the Phocus website so that you can understand how those websites collect, use and share your information. Phocus is not responsible for the privacy statements or other content on websites outside of the Site.
3. Use of Your Personal Information
Phocus collects and uses your personal information to operate the Site and deliver the services you have requested. Phocus may also use your personally identifiable information to inform you of other products or services available from Phocus and its affiliates. Phocus does not sell, rent or lease its customer lists to third parties. Phocus may keep track of the websites and pages our users visit within Phocus in order to determine what Phocus services are the most popular. This data is used to deliver customized content and advertising within Phocus to customers whose behavior indicates that they are interested in a particular subject area. Phocus will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Phocus or the site; (b) protect and defend the rights or property of Phocus; and, (c) act under exigent circumstances to protect the personal safety of users of Phocus, or the public.

The Site may use "cookies" to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Phocus secures your personal information from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.
6. Copyright Protection
You will have unrestricted license to use the images generated as result of a photo shoot that you have requested and paid for (“Client Images”). With the exception of these Client Images, all content displayed on the Site and all underlying software or technology used in connection with the Site, and all aspects thereof, including all copyrights, trademarks, and other intellectual property or proprietary rights therein, are owned by Phocus or its licensors. You acknowledge that the Site, the content and images displayed on the Site and any underlying technology or software used in connection with the Site contain Phocus's proprietary information. Phocus shall have the right to monitor the content that you provide to the Site, but shall not be obligated to do so. The contents of the Site are protected by copyright as individual works, collective work and/or compilations, pursuant to United States and foreign copyright laws. You agree to abide by all copyright notices and other restrictions contained in the Site. Access to, and use of, the Site is solely for your personal, non-commercial use. Accessing, using, displaying, performing, distributing, copying or downloading content from the Site for other than personal and non-commercial use is expressly prohibited without prior written consent of Phocus. By downloading or reproducing any information from this Site, you accept and agree to the conditions described in this Statement in their entirety without modification unless otherwise agreed to in writing by Phocus and You.
7. Opt-Out & Unsubscribe
We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from Phocus by contacting us using the contact information listed in the Contact Information section of this Policy.

Phocus will occasionally update this Privacy Policy to reflect company and customer feedback. Phocus encourages you to periodically review this Policy to be informed of how Phocus is protecting your information.
